Statement of Rights and Responsibilities

This Statement of Rights and Responsibilities ("Statement," "Terms," or "SRR") derives from the Kiwis World Ltd, and is our terms of service that governs our relationship with users and others who interact with Kiwis World, as well as products and services, which we call the \“Kiwis World Services\” or \“Services\”. By using or accessing the Kiwis World Services, you agree to this Statement, as updated from time to time in accordance with Section "Amendments" below. Additionally, you will find resources at the end of this document that help you understand how Kiwis World works.

Because Kiwis World provides a wide range of Services, we may ask you to review and accept supplemental terms that apply to your interaction with a specific product, or service. To the extent those supplemental terms conflict with this SRR, the supplemental terms associated with the product, or service govern with respect to your use of such product or service to the extent of the conflict.

Privacy Your privacy is very important to us. We designed our Data Policy to make important disclosures about how you can use Kiwis World to share with others and how we collect and can use your content and information. We encourage you to read the Data Policy, and to use it to help you make informed decisions.

The content and information you post on Kiwis World, such as at Tenants Register module, they will become public information that will be access by other users who subscribed to the same module. For content that is covered by intellectual property rights, like support documents, you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with Kiwis World (IP License). This IP License ends when you delete your IP content, unless your content has been purchased by others.
Photos you have uploaded to Passport Photo Booth module, will be automatically deleted after your subscription period expired. Or you can deleted them anytime use the delete button provided.
We always appreciate your feedback or other suggestions about Kiwis World, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).

Safety We do our best to keep Kiwis World safe, but we cannot guarantee it. We need your help to keep Kiwis World safe, which includes the following commitments by you:

You will not post unauthorized commercial communications (such as spam) on Kiwis World.
You will not collect users' content or information, or otherwise access Kiwis World, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
You will not upload viruses or other malicious code.
You will not solicit login information or access an account belonging to someone else.
You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
You will not use Kiwis World to do anything unlawful, misleading, malicious, or discriminatory.
You will not do anything that could disable, overburden, or impair the proper working or appearance of Kiwis World, such as a denial of service attack or interference with page rendering or other Kiwis World functionality.
You will not facilitate or encourage any violations of this Statement or our policies.

Registration and Account Security Kiwis World users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

You will not provide any false personal information on Kiwis World, or create an account for anyone other than yourself without permission.
You will not create more than one personal account.
If we disable your account, you will not create another one without our permission.
You will keep your contact information accurate and up-to-date.
You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
If you select a username or similar identifier for your account or Page, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).

Kiwis World Account Kiwis World maintains credit accounts for each member and from which members must pay fees for the pay services.

Kiwis World will maintain an amount that exceeds the aggregate face value of members' Kiwis World accounts (less any amounts that have been cancelled, redeemed, or forfeited in accordance with these terms and conditions) in a separate bank account. Kiwis World acknowledges and declares that all amounts deposited in that separate bank account are held on for members, such that each member has the right to a proportion of the separate bank account equal to the face value of his or her Kiwis World account. Kiwis World may deduct amounts from the separate bank account as contemplated by these terms and conditions, and reserves the right to retain any interest earned on amounts deposited in the separate bank account.

Currently Kiwis World only accepts Bank Transfer/Deposit to topup credits. You are required to send us an email to inform the transfer with reference as USERID-YYYYMMDD format. We will credit your account as soon as the money has show up in our bank account.

If your membership is terminated Kiwis World will refund the balance of your credit account, less a $5 manual processing fee that is payable to Kiwis World. Consequently, no refund will be made if the account balance is below $5. If your membership is removed due to breach of our terms and conditions it is at our discretion whether you are eligible for a refund. Promotional giveaways of Kiwis World credits, bonus credits, or any free credits gifted to the member on registration will not be refunded.

As members could earn commissions from Kiwis World website, you can cash out your credits free of charge as long as you withdraw more than $10 and your Kiwis World credit account has more than $20 credit remain after cash out. Otherwise, an $5 manual processing fee will apply.

If you have not logged on to the Website for a period of 18 months, any unused balance on your account is forfeited to Kiwis World and your membership will be suspended.

Kiwis World will ensure that, at all reasonable times, an electronic statement is available to you on the website that contains the following information:

the balance of your Kiwis World account; and
records of the past 2000 transactions of your Kiwis World account, or all transactions in the preceding 1000 days if your Kiwis World account has recorded fewer than 2000 transactions for that period; and
this statement: "The use of this account (including the conditions relating to closing the account and receiving a refund of unused deposits) is governed by Kiwis World's terms and conditions."

Trade Me will ensure that, at all reasonable times, you can check the balance of your Kiwis World account on your profile section on the site.

Fees Kiwis World charges fees for the use of the Website as a venue.

Kiwis World's current fees are listed on our fees page in the help section.

Any fees are charged at the time of subscription/purchase are not refundable.

Kiwis World reserves the right to change the fees charged for any of our Services at any time. In the event that we introduce a new Service, the fees for that Service are effective at the launch of the Service, unless otherwise stated.

If you are a New Zealand resident, then all fees are inclusive of GST and in New Zealand dollars unless otherwise stated. If you are not a New Zealand resident, then all fees are, unless otherwise stated, in New Zealand dollars and do not include GST. Unless otherwise stated in these terms and conditions, no interest or other financial charges will be applied to Kiwis World account balances.

You must pay the fees immediately upon demand by Kiwis World.

Modules At Kiwis World, we provide services in a modular base, each modules have different price. users can purchase/subscribe only to the module(s) they are required. Some modules has commission reward. In case of updating the module price and percentage of the commissions, we will announce at Kiwis World website at least 7 days prior to the changes take affected.

Tenants Register
The searchable fields in the Tenants Register will only be viewable to the owner who creates them. Other users will be showing only the encoded version.
Support documents are sold separately, owners of the support documents will get a percentage of commission for each sale. The commission rate is outlined in the Fees page.
We cannot guarantee the truthiness of all the records that are contribute by other users. However, we believed the records accompanied by some support documents will carry a little bit more weight. It is up to the users to make their own decisions.
Passport Photo Booth
The passport photo requirements are based from Immigration New Zealand (INZ) criteria. The quality of the photos are limited by the original photos supply by the users. We cannot guarantee they will all pass the Photo Checker program from INZ. However, you have unlimited tries during the subscription period. This module allow you to customize the photo size to accommodate photo size requirement from different countries. Users required to do their own research for those criteria.
Messenger
This module allow users register their username from other services. It is particularly useful when the other services does not allow users to communincate with each others directly for certain information when using the service. When two users who registered their account username for the same website. Then they can sending emails to each other. If you think your account username for the external website is been registered by another user, you can email us the proof showing your the genuine owner of that username, we will contact the other user to ask for proof on his/her side with in 3 working days. If they cannot provide proof, then we will award you with that username. As Kiwis World act as initiator to starting the email conversation, it is up to the person on the receving end to reply your email or not. We have no control over this. We reserve the right to invistigating any abuses reported of using this module, and reserve the right to terminate abuser's account.

Amendments We’ll notify you before we make changes to these terms and give you the opportunity to review and comment on the revised terms before continuing to use our Services.

If we make changes to policies, guidelines or other terms referenced in or incorporated by this Statement, we may provide notice on the Site Governance Page.

Your continued use of the Kiwis World Services, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.

Termination If you violate the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of Kiwis World to you. We will notify you by email or at the next time you attempt to access your account. You may at any time close your Kiwis World membership by giving us three days' notice in writing. If you close your membership, or if it is terminated by Trade Me, your ability to use the Kiwis World website will end. In all such cases, this Statement shall terminate.

Definitions

By "Kiwis World", "Kiwis World Ltd" or "Kiwis World Services" we mean the features and services we make available, including through (a) our website at www.kiwisworld.co.nz and any other Kiwis World branded or co-branded websites (including sub-domains, mobile versions); (b) our Platform; Kiwis World reserves the right to designate, in its sole discretion, that certain of our brands, products, or services are governed by separate terms and not this SRR.
By "Platform" we mean a set of Web Interface and services (such as content) that enable others, to retrieve data from Kiwis World or provide data to us.
By "information" we mean facts and other information about you, including actions taken by users and non-users who interact with Kiwis World.
By "content" we mean anything you or other users post, provide or share using Kiwis World Services.
By "data" or "user data" or "user's data" we mean any data, including a user's content or information that you or third parties can retrieve from Kiwis World or provide to Kiwis World through Platform.
By "post" we mean post on Kiwis World or otherwise make available by using Kiwis World.
By "use" we mean use, run, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
By "application" we mean any application or website that uses or accesses Platform, as well as anything else that receives or has received data from us. If you no longer access Platform but have not deleted all data from us, the term application will apply until you delete the data.

Other

References to "us," "we," and "our" mean either Kiwis World, or Kiwis World Limited, as appropriate.
This Statement makes up the entire agreement between the parties regarding Kiwis World, and supersedes any prior agreements.
If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.
If we fail to enforce any of this Statement, it will not be considered a waiver.
Any amendment to or waiver of this Statement must be made in writing and signed by us.
You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.
All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
Nothing in this Statement shall prevent us from complying with the law.
This Statement does not confer any third party beneficiary rights.
We reserve all rights not expressly granted to you.
You will comply with all applicable laws when using or accessing Kiwis World.

By using or accessing Kiwis World Services, you agree that we can collect and use such content and information in accordance with the Privacy Policy as amended from time to time. You may also want to review the following documents, which provide additional information about your use of Kiwis World.
